Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Noor Taj ("we," "us," or "our") regarding your use of the TruePlot mobile application.

1. Acceptance of Terms

By accessing or using the App, you represent and warrant that:

• You are at least 4 years of age (the minimum age rating for this App)
• You have the legal capacity to enter into these Terms
• You will comply with all applicable local, national, and international laws and regulations
• You have read, understood, and agree to be bound by these Terms and our Privacy Policy
• You are not located in a country subject to a U.S. government embargo

2. Description of Service

TruePlot is a GPS-based area measurement application that allows users to:

• Search for addresses and locations using Google Places autocomplete
• Measure land area by tapping pins on a satellite map (Tap-to-Pin mode)
• Measure land area by walking the boundary using GPS (Walk Boundary mode)
• Measure multiple areas on a single map view
• Switch between various measurement units (marla, kanal, bigha, square feet, square meters, acres, hectares, and more)
• Save measurement history with names, dates, and map thumbnails
• Export measurements as PDF reports or PNG images
• View GPS signal strength for measurement confidence

The App is provided free of charge. All measurements and data are stored locally on your device.

3. License to Use

3.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device(s) solely for your personal, non-commercial use.

3.2 Restrictions

You agree NOT to:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any illegal, fraudulent, or unauthorized purpose
• Sell, rent, lease, sublicense, distribute, or transfer the App to any third party
• Use the App in any way that could damage, disable, overburden, or impair our services
• Attempt to gain unauthorized access to any part of the App or related systems
• Use any automated system, bot, or script to interact with the App
• Use the App for professional surveying without verifying measurements through official methods

4. Measurement Accuracy and Disclaimer

4.1 General Accuracy

The accuracy of area measurements in TruePlot depends on:

• GPS signal quality: Strong GPS signals can achieve accuracy within approximately 2 meters. Moderate and weak signals will produce less accurate results.
• Satellite imagery: The clarity and recency of satellite imagery from Google Maps affects the precision of tap-to-pin measurements.
• User technique: Accurate pin placement and careful boundary walking directly impact measurement results.
• Device hardware: GPS chipset quality varies across devices and affects measurement accuracy.

4.2 No Professional Survey Guarantee

TruePlot is not a professional surveying tool. It does not replace:

• Licensed professional land surveys
• Government land records and cadastral surveys
• Formal property boundary determinations
• Legal property descriptions
• Title company verifications

4.3 User Responsibility

You acknowledge and agree that:

• You are solely responsible for verifying any measurements before making financial decisions
• Measurements should be cross-checked with official records for any binding transaction
• The App provides estimates, not guarantees
• We are not liable for any financial loss, property disputes, or other consequences resulting from reliance on App measurements
• You should consult a licensed surveyor for official measurements required for legal or financial purposes

5. User Responsibilities

5.1 Device and Connectivity

You are responsible for:

• Maintaining a compatible device with sufficient storage and battery life
• Ensuring GPS is enabled for walk-the-boundary measurements
• Providing internet connectivity for address search and map loading
• Understanding that GPS measurement may not work in all environments (indoor, dense urban areas, heavy tree cover)

5.2 Data Backup

You are solely responsible for backing up any measurement data you enter into the App. Since all data is stored locally on your device, uninstalling the App or clearing app data will permanently delete your measurements. We are not responsible for any loss of data.

5.3 Permitted Use

You agree to use the App only for lawful purposes. You must not use the App to:

• Trespass on private property or violate property rights
• Harvest or collect location data for unauthorized purposes
• Create fraudulent or misleading measurements
• Violate any applicable laws regarding land measurement, property boundaries, or surveying

6. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your information, including location data.

Key Privacy Points:

• Location data is used only during active measurement sessions
• All measurement data is stored locally on your device
• We do not collect personal identification information
• Anonymous analytics help us improve the App
• You can use the App without granting location access (tap-to-pin mode)

7. Intellectual Property

7.1 Ownership

The App, including all content, features, functionality, design, code, graphics, and user interface, is owned by Noor Taj and is protected by copyright, trademark, patent, and other intellectual property laws. All rights not expressly granted to you are reserved.

7.2 Trademarks

"TruePlot," the TruePlot logo, and related names are trademarks of Noor Taj. You may not use these trademarks without our prior written permission.

7.3 User-Generated Content

You retain all rights to measurement data, plot names, and map annotations you create using the App. We do not claim ownership of your measurements or data. However, by using the App, you grant us a non-exclusive, worldwide, royalty-free license to use anonymized, aggregated usage data to improve the App.

7.4 Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas for improving the App, you grant us the right to use such feedback without compensation or obligation to you.

8. Third-Party Services

8.1 Google Maps and Google Places

The App uses Google Maps API and Google Places API for map display, satellite imagery, and address search. Your use of these features is subject to Google's Terms of Service:

8.2 No Endorsement

The integration of third-party services does not imply our endorsement of those services. We are not responsible for the content, accuracy, or practices of third-party services.

9. Disclaimers and Limitations of Liability

9.1 No Warranty

To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or completeness of measurements
• Warranties that the App will be uninterrupted, timely, secure, or error-free
• Warranties that defects will be corrected or that the App is free of viruses or other harmful components
• Warranties regarding GPS accuracy, satellite imagery quality, or map data

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Noor Taj be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Property disputes, financial losses, or legal costs resulting from measurement inaccuracies
• Personal injury or property damage
• Damages resulting from missed measurements, incorrect data, or device failure
• Any damages arising from your use or inability to use the App
• Any damages resulting from third-party conduct, including Google Maps errors

9.3 Maximum Liability

In no event shall our total liability to you for all claims exceed the amount you paid for the App (currently $0.00 for the free version).

9.4 Basis of the Bargain

You acknowledge that we have made the App available in reliance upon the limitations of liability set forth herein, which allocate risk between us and form a basis of the bargain between the parties.

10. Indemnification

You agree to indemnify, defend, and hold harmless Noor Taj, its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights, including property rights or privacy rights
• Any claim that your use of the App caused damage to a third party
• Any disputes arising from measurements you share with third parties

11. Termination

11.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. No notice is required.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security issues
• Discontinuation of the App

11.3 Effect of Termination

Upon termination:

• Your license to use the App immediately terminates
• You must uninstall the App from all devices
• Any locally stored measurement data will be lost unless you have backed it up
• Sections of these Terms that by their nature should survive termination shall continue to apply

12. Updates and Modifications

12.1 App Updates

We may release updates to the App that add features, fix bugs, improve performance, or change functionality. You may need to install updates to continue using the App. We are not responsible if you cannot use the App due to outdated software or incompatible device hardware.

12.2 Changes to the App

We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

12.3 Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date at the top of this page
• Displaying an in-app notification for significant changes

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of laws provisions.

13.2 Informal Resolution

Before filing any formal legal action, you agree to first contact us at noort9773@gmail.com to seek an informal resolution of any dispute. We will work in good faith to resolve the issue within 30 days.

13.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority in Pakistan. The arbitration shall be conducted in English.

13.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13.5 Venue

For any disputes not subject to arbitration, you agree to submit to the personal jurisdiction of the courts located in Pakistan.

14. App Store and Play Store Terms

14.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Noor Taj, not Apple Inc.
• Apple has no obligation to provide maintenance, support, or warranty for the App
• Apple is not responsible for addressing any claims relating to the App or your possession/use of it
• Apple is not responsible for any third-party intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• You represent and warrant that you are not located in a country subject to a U.S. government embargo
• You acknowledge that Apple has no obligation to furnish any maintenance or support services with respect to the App
• Your use of the App must comply with Apple's App Store Terms of Service

14.2 Google Play Store

If you downloaded the App from the Google Play Store, you agree to comply with Google Play's Developer Distribution Agreement and Terms of Service. Google is not a party to these Terms and has no liability or obligation regarding the App.

14.3 Both Stores

You acknowledge that the App Store and Google Play Store are third-party beneficiaries of these Terms and have the right to enforce these Terms against you.

15. Export Control

You agree to comply with all applicable export and re-export control laws and regulations, including those of the United States and Pakistan. You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to such embargo or sanctions.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Noor Taj regarding the App and supersede all prior agreements and understandings, whether written or oral.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

16.4 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction, with notice to you.

16.5 Relationship

Nothing in these Terms shall be deemed to create a partnership, joint venture, agency, or employment relationship between you and Noor Taj.

16.6 Force Majeure

We shall not be liable for any delay or failure in performance resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network failures, power outages, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16.7 Notices

All notices regarding these Terms shall be sent to the email address provided in the Contact Information section below. We may provide notices to you through the App or by posting on our website.
